한눈에 보는 청탁금지법 / 신고처리 절차및보호·보상 ○ 부정청탁 : - 최초 부정청탁: 거절의사 표시 - 동일한 부정청탁: 소속기관장에게 신고 (국민권익위원회, 감독기관，감사원，수사기관에도 산고 가능) ○ 금품등 수수 :-소속기관장에게 신고(국민권익위원회, 감독기관, 감사원，수사기관에도 신고 가능) - 제공자에게 반환·보상 거부의사 표시(반환곤란한 경우 소속기관장에게 인도)→ - 신고내용에 대한 감사·수사·조사→ - 수사 필요성이 있는 경우 수사기관에 통보 - 과태료 부과 대상자 관할 법원 통보(소속기관장) - 징계，직무 배제 등 조치, 부정청탁 내용·조치 사항 공개(소속기관장) 신고자 보호·보상 - 보호:불이익조치금지,원상회복조치,신분비밀·신변보호,책임감면 등, 보상:보상금(최대 30억원) 포상금(최대2억원)지급1.금품등수수 금지 / 금지 내용 - 직무와 관련하여 금품등 수수 금지- 직무와관련이 없는 경우에도 1 회 100만원(매 회계연도 300만원)을넘는 금품등 수수금지 / 예외사유 - 공공기관이 소속 공직자등에게 지급하거나상급 공직자등이 위로·격려·포상등의목적으로하급 공직자등에게 제공하는 금품등 - 원활한 작무수행, 사교·의례 또는 부조의 목적으로 제공되는 대통령령으로 정하는 가액 범위 안의 음식물·경조사비·선물 - 정당한 권원에 의하여 제공되는 금품등 - 공직자등의 친족(「민법」제777조에 따른찬족)이제공하는금품등 - 직원상조회·동호인회·동창회·향우회·친목회·종교단체·사회단체 등이 정하는 기준에 따라구성원에게 제공하는 금품등 - 직무와 관련된 공식적 행사에서 주최자가 참석자에게 통상적 범위에서 일률적으로제공하는교통·숙박·음식물 등 - 불특정 다수인에게 배포하기 위한 기념품 또는 홍보용품 등이나경연·추첨을 통하여 받는보상또는 상품 등 - 그밖에 다른 법령·기준또는사회상규에 따라 허용되는금품등 / 제재 내용 - 제재대상 : 1 회 1 백만원(매 회계연도 3백만원)을 넘는 금품등을 수수한 공직자등과 제공한 사람, 제재의 종류 : 3년 이하의 징역 또는3천만원 이하의 벌금 - 제재대상 : 직무와 관련하여1 회 1 백만원 이하의 금품등을 수수한공직자등과 제공한 사람, 제재의 종류 : 수수 금액의 2배 이상5배 이하의 과태료 / 2.부정청탁 금지 금지내용 - 누구든지 직무를 수행하는 공직자등에게 직접 또는 제3자를통한 부정청탁 금지 / 예외사유 법령 • 기준에서 정하는 절차 • 방법에 따라 특정한 행위를요구하는 행위• 공개적으로 특정한 행위를 요구하는 행위• 선출직 공직자 • 정당 • 시민단체 등이 공익적인 목적으로제3자의 고충민원을 전달하는 행위• 법정기한 안에 처리해 줄 것을 신청 • 요구하거나 그 진행상황 • 조치결과등에 대하여 확인 • 문의하는 행위• 직무 또는 법률관계에 관한 확인 • 증명 등을 신청 • 요구하는행위• 질의 또는상담형식을 통하여 직무에 관한 법령 • 제도 • 절차등에 대하여 설명이나 해석을 요구하는 행위• 그밖에 사회상규에 위배되지 아니하는 것으로 인정되는 행위 / 제재 내용 - 제제대상 : 제3자률 통하여 부정청탁한 사람, 제재의 종류 : 1천만원 이하의 과태료 / - 제제대상 : 제3자를 위하여 부정청탁한 사람(제3자률 위하여 부정청탁한 공직자등), 제재의 종류 : 2천만원 이하의 과태료(3천만원 이하의 과태료) / - 제제대상 : 부정청탁에 따라 작무률 수행한 공직자등, 제재의 종류 : 2년 이하의 징역 또는 2천만원 이하의 벌금 / 3.목적 및 적용대상 - 목적 : 부정청탁，금품 수수 근절을 통한 공정한 직무수행，공공기관에 대한신뢰 확보 / 적용대상 - 공공기관 : - 헌법기관，중앙행정기관，지방자치단체, - 공작유관단체 각급학교、학교법인，언론사등 / 공직자들 : - 국가•지방공무원，공직유관단체의장과 임직원 - 각급 학교의 장과 교직원 - 학교법인 • 언론사의 대표자와 임직원

 

 

 

IMPROPER SOLICITATION AND GRAFT ACT / REPORTING PROCEDURE & PROTECTION • REWARDS / IMPROPER SOLICITATION - Express intention of rejection upon receipt of improper solicitation for the first time - Report in writing to the head of the relevantorganization upon receipt of repeated impropersolicitations(Reports can be made to supervisory institutions, Boardof Audit and Inspection, investigative agencies orACRC) MONEY, GOODS, ETC. - Report to the head of the relevant organization(Reports can be made to supervisory institutions,Board of Aud比 and Inspection, investigative agenciesorACRC)- Return the received item to the provider(Deliver the item to the head of relevant agency,if returning it is impossible) - Audit, inspection or investigation of the report - Notify an investigative agency of the report if investigation is deemed necessary- Report violation subject to administrative fine to a competent court(head of the relevant agency)一 Disclose disciplinary actions, other measures such as exclusion from the duties,and details of the improper solicitation and measures taken against it(head of the relevant agency) REPORTER PROTECTION • REWARDS Protection - Protective measures for reporters such as prohibition of disadvantageousmeasures, invalidation of unfair measures, confidentiality/personalprotection, mitigation of liability Rewards - Monetary rewards (up to KRW 3 billion) or awards (up to KRW 200 million) UPPER LIMIT OF ACCEPTABLEMONEY, GOODS, ETC. Congratulatory or condolence money, gifts, or food and beveragesprovided for aids, social relationships or rituals are acceptable as0cception ACCEPTABLE MONEY,GOODS, ETC. Congratulatory/condolence money UPPER LIMIT KRW 50,000 for wedding or funeral cash gifts(KRW 100,000 in case of wreaths or flowers for weddings or funeral) ACCEPTABLE MONEY,GOODS, ETC. Gifts UPPER LIMIT KRW 50,000(KRW 100,000 in case of agricultural and fishery goods or agriculturaland fishery produce) ACCEPTABLE MONEY,GOODS, ETC. Food and beverages UPPER LIMIT KRW 30,000 NOTE— If agricultural or fishery products are offered with other gifts, the total acceptable valuecan be KRW 100,000 or less, but the value of that other gifts should not exceed KRW50,000— If condolence or congratulatory money is offered with flowers or wreaths, the totalacceptable value can be KRW 100,000 or less, but the condolence or congratulatorymoney should not exceed KRW 50,000 Marketable securities including gift certificates are excluded fromacceptable gifts. PROHIBITION OF MONEY, GOODS, ETC PROHIBITED MONEY, GOODS, ETC.- In relation to duties, public servants are banned from receiving money, goods, etc.一 Regardless ofduty-relatedness, public servants are banned from receiving money,goods, etc. exceeding KRW 1 million at a time or KRW 3million for a fiscal year EXCEPTIONS • Money, goods, etc. that public organizations offer to their public officials or that seniorpublic officials offerto their subordinates for consolation, encouragement, or reward• Food and beverages, congratulatory or condolence money, or gifts offered to facilitateperformance of public duties, social relationships, rituals or aids within the limit of valueprovided by Presidential Decree• Money, goods, etc. offered from a legitimate source of right• Money or goods provided by relatives (defined in Article 777 oftheCivilAct)ofa publicservant• Money, goods, etc. provided by employees' mutual aid societies, clubs, alumniassociations, hometown associations, friendship clubs, religious groups, socialorganizations, etc., to their members accordingto internal rules.• Transportation, accommodation, or food provided uniformly in a normally acceptedrange by an organizer of a duty-related official event• Souvenirs, promotional goods, etc. distributed to multiple unspecified persons, orawards or prizes given in a contest or a lottery• Financial or other advantages permitted by other statutes, standards or societal rules and norms PUNISHMENT SUBJECT TO PUNISHMENT A public official who received money, goods, etc exceedingKRW 1 million at a time or KRW 3 million for a fiscal year,and the provider PUNISHMENT Imprisonment of up to 3 years or a fineof up to KRW 30 million SUBJECT TO PUNISHMENT A public official who received duty-related money, goods,etc. not exceeding KRW 1 million at a time, and the provider PUNISHMENT Administrative fine of 2 to 5 times thebenefits received PROHIBITION OF IMPROPER SOLICITATION PROHIBITED SOLICITATIONAnyone should not make improper solicitation to a public official performing publicduties directly or through a third party EXCEPTIONSr• Requesting certain actions according to the procedures or methods prescribedor standards• Publicly requesting certain actionsby Acts• An elected public servant, political party, civil society organization, etc., conveys a thirdparty’s complaints for the public interest• Requesting or demanding a public institution to complete a certain duty withina statutory deadline, or asking confirmation or inquiring about the progress orout的me thereof• Requesting or demanding confirmation or certification for duties or legal relations• Demanding explanation or interpretation of Acts, systems, or procedures, etc.related to duties through inquiry or consultation• Any other conduct recognized to be consistent with societal rules and norms PUNISHMENT SUBJECT TO PUNISHMENT A person making improper solicitation through a third party PUNISHMENT Administrative fine of up to KRW10 million SUBJECT TO PUNISHMENT A person making improper solicitation for a third party(A Public servants, etc. making improper solicitation for athird party) PUNISHMENT Administrative fine of up to KRW 20 million(Administrative fine of up to KRW30 million) SUBJECT TO PUNISHMENT A public servant, etc. performing duties as solicited PUNISHMENT Imprisonment of up to 2 years or fine of upto KRW 20 million PURPOSE & SCOPE PURPOSE OF THE ACTTo enable public officials to perform their duties uprightly and securepublic trust in public institutions by removing improper solicitationand graft to public servants
